Who we are

Kiswave is operated by {{OPERATOR_LEGAL_NAME}}, {{OPERATOR_ADDRESS}} (“Kiswave”, “we”). You can reach us at {{OPERATOR_EMAIL}}.

These terms apply to store owners and their staff who use Kiswave to run a store (“Stores”), and to guests who order from a Store through Kiswave (“Guests”).

What Kiswave does

Kiswave is ordering and payment software. Guests order and pay from their own phone with a QR code. Stores follow and prepare orders on their own tablets, take payments at the counter and see their sales.

Orders are between the Guest and the Store

Orders are sold by the Store. Kiswave provides the ordering service and is not a party to the sale. The Store sets its menu and prices, prepares the order, and is responsible for it, for refunds and for complaints. The Store’s business information is shown at the bottom of its menu and on receipts.

Store accounts

  • You must run a lawful business and give true, current information, including the business information shown to Guests.
  • You are responsible for your account, your staff, the devices you register and everything done with them. Keep your password and staff PINs secret.
  • You must follow the laws that apply to your store, including consumer, tax, food and privacy laws, and tell your Guests about your own refund rules.

Payments

Card payments go through Stripe directly to the Store’s own Stripe account and are subject to Stripe’s terms. Kiswave does not hold Store funds. Payments taken at the counter in cash or on the Store’s own card terminal are only recorded in Kiswave.

Subscriptions and billing

  • Each store has a subscription plan. A free trial is offered once per organization.
  • Paid plans are billed monthly in advance to the card on file. Prices exclude taxes unless stated.
  • You can cancel at any time. The subscription then ends at the end of the current period, with no refund for the part already paid. Closing a store ends its subscription at once, with no refund for the rest of the period.
  • If a payment fails, store settings lock after a grace period and online ordering stops later, as shown in the owner app.

Acceptable use

Do not use Kiswave to sell unlawful goods or services, to mislead Guests, to break into or overload the service, to copy it, or to collect other people’s data without a lawful basis.

Personal data

Our Privacy Policy explains what we collect and why. For Guest order data, Kiswave processes the data to run the Store’s orders and receipts.

Changes and availability

We keep improving Kiswave and may change features. We tell Stores about material changes to these terms in advance and ask them to agree again before they continue. We aim for high availability but do not promise that the service is never interrupted.

Liability

To the extent the law allows, Kiswave is not liable for indirect or consequential losses, and our total liability to a Store is limited to the fees it paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Ending the service

A Store can close a store or its whole organization at any time from the owner app, and can export its data first. We may suspend an account that breaks these terms or the law. Order and payment records are kept for the periods the law requires.

Governing law

These terms are governed by {{GOVERNING_LAW}}. Guests and Stores keep any mandatory protections of the laws of the country they live in.
